2004-03-09 Décision sur requête en autorisation d'intervention, Arb, The motion for an extension of time to apply for leave to intervene is granted.
The motion for leave to intervene is granted. The intervener, the Freehold Petroleum & Natural Gas Owners Association, shall be entitled to serve and file a factum not to exceed 20 pages in length on or before April 1, 2004.
The request to present oral argument is deferred to a date following receipt and consideration of the written arguments of the parties and the intervener.
Pursuant to Rule 59 (1)(a) the intervener shall pay to the appellants and respondents any additional disbursements occasioned to the appellants and respondents by the intervention.
The motions for leave to cross-examine Else Pedersen are dismissed.
IT IS FURTHER ORDERED THAT:
The intervener shall not be entitled to adduce further evidence or otherwise to supplement the record of the parties. In its material the intervener indicates that it intends to make submissions respecting the potential consequences this Court's decision will have on an issue which is not otherwise going to be addressed by the appellants or respondents: the ownership of coal bed methane. The role of an intervener does not generally involve or contemplate new issues being introduced or new evidence being adduced. Accordingly, as the ownership of coal bed methane is not an issue properly before this Court on this appeal, the intervener should not address this issue in its submissions. Similarly, the intervener should not make reference to the testimony provided by Mr. James Lewis at the trial level in the case of Borys v. C.P.R., [1951] 2 W.W.R. (NS) 145 (Alta S.C.); rev'd in part, [1952] 4 W.W.R. (NS) 481 (Applicant. Div.), aff'd, [1953] 7 W.W.R. (NS) 546 (P.C.), since this evidence was not adduced at trial and does not form part of the record on this appeal.

Les faits ont été résumés comme suit par la Cour d’appel En 1912, le Chemin de fer canadien du Pacifique a commencé la cession de lots de ferme à des colons mais en se réservant la propriété de “tout charbon, pétrole et pierre utile qui pourrait être découvert sur ledit terrain ou dans sa partie sous-jacente”. Un démembrement de la propriété du gisement d’hydrocarbures résultait de cette politique : le charbon, le pétrole et la pierre utile appartenaient au “propriétaire du pétrole” et les autres minéraux au “propriétaire des autres minéraux”. Les auteurs des appelants étaient propriétaires des autres minéraux et ceux des intimés propriétaires du pétrole.

La question en litige a généré 84 procès. Relativement aux droits d’un propriétaire des autres minéraux, la juge de première instance a décidé que la propriété du gaz naturel se trouvant dans des gisements à deux propriétaires était fonction des conditions dans lesquelles était le réservoir avant que n’en débute l’exploitation. La Cour d’appel a rejeté l’appel formé contre cette décision, sauf en ce qui a trait aux conclusions de la juge de première instance sur le gaz naturel provenant des eaux emprisonnées dans des roches.
