Civil procedure – Time – Motion to enter case on roll 18 years after struck from roll – Whether Court of Appeal erred in not granting leave to appeal dismissal of proceeding.
The complaint brought by the Applicant, a draftsperson, against his former employer, the Respondent company, was held to be unfounded by the Commission des droits de la personne in October 1991. In April 1992, the Superior Court struck out the action instituted by the Applicant. In January 2010, the Applicant applied to have the action re-entered on the roll; his former employer filed a motion to dismiss the action.
