The Court of Appeal set out the following facts. The Appellant pleaded guilty to three separate offences: possession of a weapon for purposes dangerous to the public peace; arson; and, breach of an undertaking. The weapons offence arose when he approached another youth during an argument with a metal table leg held above his head. The arson offence occurred while he was on release for the weapons charge. The Appellant and an adult offender poured gasoline into a truck and the adult offender set the truck on fire, at the request of the truck’s owner who sought to collect $25,000 from his insurer. The breach of an undertaking arose when the Appellant was found in the company of a person he was ordered to have no contact with as a condition of his release on the weapons charge. The Appellant was sixteen and seventeen years old at the time of the offences. For all three offences, he was sentenced to six months deferred custody with mandatory terms, nine months probation, and a prohibition against use of alcohol and non-prescribed drugs. In separate sentencing proceedings, the adults were given conditional sentences of nine and twelve months. The Appellant appealed from his sentence. Before judgment was rendered in his appeal, he breached the conditions of his deferred custody order and he was placed in an open custody facility until the Crown agreed to his release on bail. The Court of Appeal upheld the sentence.
