This appeal comes to us as of right. In the final analysis, we agree with the majority in the Ontario Court of Appeal (2002), 5 C.R. (6th) 157 that: "While there was evidence upon which a trier of fact could make a finding of dangerous driving, in the circumstances, the failure to do so did not amount to an error of law" (para.11).
Accordingly, the appeal is dismissed.
