Keywords

Civil procedure — Access to justice — Fundamental justice — Applicant attempting to add defendants to civil claim — Chambers judge setting aside applicant’s filings purporting to add parties to action — Court of Appeal quashing applicant’s appeal for lack of merit — Whether application for leave to appeal raises legal question, and if so, whether question is of sufficient public importance to warrant consideration.

Summary

Case summaries are prepared by the Office of the Registrar of the Supreme Court of Canada (Law Branch). Please note that summaries are not provided to the Judges of the Court. They are placed on the Court file and website for information purposes only.

After sustaining injuries following a motor vehicle accident, the applicant filed an action in the Supreme Court of British Columbia against the respondent insurance company. The applicant then proceeded to file various documents to add defendants to his civil action. The chambers judge set aside the applicant’s filings. The applicant appealed the order, and also filed multiple applications before the Court of Appeal seeking various forms of miscellaneous relief. A single appellate judge dismissed all applications for relief, and a three-member panel of the Court of Appeal quashed the applicant’s appeal from the chambers judge’s order.
