2025-03-27 Judgment on the appeal rendered, Row Mar Kas Ob Mor, The appeal from the judgment of the Court of Appeal for Saskatchewan, Number CACR3547, 2024 SKCA 50, dated May 9, 2024, was heard on March 27, 2025 and the Court on that day delivered the following judgment orally:


MOREAU J. — This is an appeal as of right from the Court of Appeal for Saskatchewan. The respondent was found guilty of sexual assault. He appealed his conviction.

The Court of Appeal was unanimous that the trial judge made reviewable errors in her treatment of the respondent’s evidence and in her analysis of his defence of honest but mistaken belief in consent. Justices Barrington-Foote and Drennan, for the majority, found that the verdict was unreasonable and entered an acquittal. Justice Tholl, dissenting, would have quashed the conviction and ordered a new trial.


Before this Court, the Crown submits that the majority erred by finding that the verdict was unreasonable. A majority of this Court would allow the appeal, substantially for the reasons of Justice Tholl. Justice Rowe would have dismissed the appeal, substantially for the reasons of the majority in the Court of Appeal.


Accordingly, the appeal is allowed and a new trial is ordered.

A bar owner drove one of his clients, the complainant, home after the bar closed. On the way home, the bar owner and the complainant had unprotected penetrative intercourse. At trial, the bar owner testified that he believed that the complainant had consented. The complainant testified that she had minimal recollection of the drive. The trial judge inferred from the evidence that the complainant lacked capacity to consent to the sexual activity. The bar owner was convicted of sexual assault.

The Court of Appeal unanimously agreed that the trial judge erred in the assessment of the bar owner’s evidence and erred in relying on myths and stereotypes in her reasons. However, the Court of Appeal was divided on the issue of remedy. The evidence of the complainant’s capacity to consent was circumstantial. The majority concluded that the application of Villaroman principles to the circumstantial evidence permitted an inference inconsistent with guilt, and also that there was no legally admissible evidence at trial that would permit a properly instructed trier of fact to convict the bar owner. In dissent, Tholl J.A. concluded that a reasonably instructed trier of fact could have found the bar owner guilty. Accordingly, Tholl J.A. would have ordered a new trial.
