The motion for extension of time is granted.

Leave to intervene is denied to the Raoul Wallenberg Centre for Human Rights, as its motion for leave to intervene raises a new issue, being whether equality should be recognized as a principle of fundamental justice under section 7 of the Charter of Rights and Freedoms. This intervention, if allowed, would have the effect of expanding the case.

Leave to intervene is denied to Defend Dignity, as its motion for leave to intervene seeks leave to introduce new evidence from former sex workers who are not parties to this case whereas the record of the case includes evidence from the complainants in this proceeding and witnesses, all of whom were sex workers. This motion for leave to intervene does not identify submissions that are different from those of the other parties as required under Rule 57(2)(b) of the Rules of the Supreme Court of Canada.

Leave to intervene is denied to the Canadian Association of Refugee Lawyers, as its motion for leave to intervene raises a new issue, being the application of the Immigration and Refugee Protection Act, S.C. 2001, c. 27, and the Immigration and Refugee Protection Regulations, SOR/2002-227. This intervention, if allowed, would have the effect of expanding the case.

Leave to intervene is denied to the Migrant Workers Alliance for Change, as its motion for leave to intervene raises new issues, being the application of the Immigration and Refugee Protection Act, S.C. 2001, c. 27, and the impact of the criminal provisions in issue on migrant sex workers. This intervention, if allowed, would have the effect of expanding the case.

Leave to intervene is denied to AWCEP Asian Women for Equality Society, as its motion for leave to intervene raises new issues, being the impact of prostitution on Asian women and children and the trafficking of Asian women into Canada for purposes of prostitution. This intervention, if allowed, would have the effect of expanding the case.

Leave to intervene is denied to the Canadian Alliance for Sex Work Law Reform, as its motion for leave to intervene raises a new issue, being unrelated proceedings brought before the Ontario Superior Court of Justice, File No. CV-21-00659594-0000, and the Court of Appeal for Ontario, No. C70956. This intervention, if allowed, would have the effect of expanding the case.

The motion for leave to intervene by Ms. Tiffany Anwar is granted, to bring the perspective of a former owner and operator of an escort service agency which is not otherwise represented by the parties to the proceeding. Ms. Anwar is directed not to raise in issue the proceedings before the Ontario Superior Court of Justice in File No. CV-21-00659594-0000 and the appeal proceedings before the Court of Appeal for Ontario in File No. C70956 or to file materials from the records in those proceedings.

The eleven (11) interveners or groups of interveners shall each be entitled to serve and file a factum not to exceed ten (10) pages in length and a book of authorities, if any, on or before July 8, 2024.

The eleven (11) interveners or groups of interveners are each granted permission to present oral argument not exceeding five (5) minutes at the hearing of the appeal.

The Attorney General of Canada, the Attorney General of Ontario, the Attorney General of Nova Scotia, the Attorney General of Manitoba and the Attorney General of British Columbia are each granted permission to present oral argument not exceeding ten (10) minutes at the hearing of the appeal.

The appellants and respondent are each granted permission to serve and file a single factum in reply to all interventions not to exceed ten (10) pages in length on or before July 15, 2024.

The interveners or groups of interveners are not entitled to raise new issues or to adduce further evidence or otherwise to supplement the record of the parties.

Following their trial, the appellants, Mikhail Kloubakov and Hicham Moustaine, were convicted of obtaining a material benefit from sexual services (s. 286.2(1) of the Criminal Code) and of procuring, as parties (s. 286.3(1) of the Criminal Code). However, after entering the convictions, the trial judge determined that the provisions in question were overbroad and that they deprived certain sex workers of the right to security without being in accordance with the principles of fundamental justice, thereby infringing s. 7 of the Canadian Charter of Rights and Freedoms. She held that the infringements were not justified under s. 1 of the Charter, and she accordingly declared ss. 286.2(1), (4) and (5) and 286.3(1) unconstitutional and suspended the declaration of invalidity for 30 days. She entered a stay of proceedings as a remedy. The Alberta Court of Appeal allowed the appeal, set aside the declarations of invalidity concerning ss. 286.2 and 286.3 and the stay of proceedings, and entered convictions against Mr. Kloubakov and Mr. Moustaine. It referred the matter back to the Court of King’s Bench for sentencing. In its view, the impugned provisions did not infringe s. 7, and a s. 1 analysis was therefore unnecessary.
