IT IS HEREBY ORDERED THAT:

The motions for leave to intervene by the Director of Public Prosecutions; Pivot Legal Society; Canadian Civil Liberties Association;
Criminal Lawyers’ Association (Ontario);
La Coalition canadienne des politiques sur les drogues, l’Association des intervenants en dépendance du Québec et l’Association des infirmiers et infirmières en réduction des méfaits jointly; are granted and the said interveners or groups of interveners shall be entitled to each serve and file a single factum common not to exceed ten (10) pages in length on or before August 26, 2024.

The motion for leave to intervene by John Howard Society of Saskatchewan is granted in part, on the issue of the impact of s. 4.1(5) of the Controlled Drugs and Substances Act on the interpretation of s. 4.1 of the Act. John Howard Society of Saskatchewan is directed not to raise the experiences and perspectives of people exiting custody or to supplement the record with fresh evidence. The intervener shall be entitled to serve and file a single factum not to exceed ten (10) pages in length on or before August 26, 2024.

The said interveners or groups of interveners are each granted permission to present oral argument not exceeding five (5) minutes at the hearing of the appeal.

The appellant is granted permission to serve and file a single factum in reply to all interventions not to exceed five (5) pages in length on or before September 3, 2024.

Leave to intervene is denied to Empowerment Council; HIV Legal Network and HIV & AIDS Legal Clinic Ontario; Canadian Students for Sensible Drug Policy; Community & Legal Aid Services Program; as these motions raise new issues. These interventions, if allowed, would have the effect of expanding the case.

The interveners or groups of interveners are not entitled to raise new issues or to adduce further evidence or otherwise to supplement the record of the parties.

Pursuant to Rule 59(1)(a) of the Rules of the Supreme Court of Canada, the interveners or groups of interveners shall pay to the appellants and the respondents any additional disbursements resulting from their interventions.

Section 4.1(2) of the Controlled Drugs and Substances Act, S.C. 1996, c. 19, provides that no person who seeks emergency medical or law enforcement assistance because that person, or another person, is suffering from a medical emergency is to be charged or convicted of the offence of simple possession of a controlled substance if the evidence in support of that offence was obtained or discovered as a result of that person having sought assistance or having remained at the scene of the medical emergency. Mr. Wilson was with three other people when one overdosed on fentanyl and one of them called 911. Police responding to the 911 call arrested Mr. Wilson for simple possession of a controlled substance at the scene of the overdose. Police conducted a search of the group’s truck and, in a green backpack, discovered modified handguns, parts for firearms, ammunition and identification papers. Later at a police station, Mr. Wilson admitted he was the owner of the green backpack, the guns and the ammunition. He admitted that the identification papers did not belong to him. Mr. Wilson was charged with possession of identity documents, fraudulent impersonation and a number of firearms offences. He was not charged with possession of a controlled substance. The trial judge dismissed an application for a declaration that the evidence should excluded for breaches of ss. 8 and 9 of the Charter of Rights and Freedoms and admitted the evidence. Mr. Wilson was convicted of firearms offences. The Court of Appeal allowed an appeal and entered acquittals on all counts.
