IT IS HEREBY ORDERED THAT:

The motions for leave to intervene are granted and the sixteen (16) interveners or groups of interveners shall each be entitled to serve and file a factum not to exceed ten (10) pages in length and book of authorities, if any, on or before September 8, 2023.

The sixteen (16) interveners or groups of interveners are each granted permission to present oral argument not exceeding five (5) minutes at the hearing of the appeal.

The appellant and respondent are each granted permission to serve and file a single factum in reply to all interventions not to exceed five (5) pages in length on or before September 25, 2023.

To the extent that their interests are similar, the interveners or groups of interveners shall focus on submissions which are different from those of the other parties, and shall consult to avoid repetition in their submissions.


The interveners or groups of interveners are not entitled to raise new issues or to adduce further evidence or otherwise to supplement the record of the parties.

Pursuant to Rule 59(1)(a) of the Rules of the Supreme Court of Canada, the interveners or groups of interveners shall pay to the appellant and the respondent any additional disbursements resulting from their interventions.

The private communications of two teachers, recorded on their personal, password-protected log were read and captured by screenshots taken by their school principal, and then used by the respondent school board (“Board”) to discipline them. The union filed a grievance against the written reprimand issued to the teachers (“Grievors”) claiming the Board violated the Grievors right to privacy by assessing private digital information without reasonable cause and using that information as the basis for an investigation that led to the discipline.

By the time the grievance was heard, the written reprimands had been removed from the Grievors’ records. But the parties agreed to move forward with the issue of the alleged breach of the right to privacy.

The arbitrator dismissed the grievance against the Board. The majority of the Divisional Court upheld the arbitrator’s decision and dismissed the appeal. The Court of Appeal allowed the appeal and quashed the award of the arbitrator.
