IT IS HEREBY ORDERED THAT:

The motion for leave to intervene by the Attorney General of Ontario is dismissed.

The motion for leave to intervene by the British Columbia Civil Liberties Association is granted and they shall be entitled to serve and file a factum not to exceed ten (10) pages in length, and book of authorities, if any, on or before April 28, 2023.

The British Columbia Civil Liberties Association is granted permission to present oral argument not exceeding five (5) minutes at the hearing of the appeal.

The intervener is not entitled to raise new issues or to adduce further evidence or otherwise to supplement the record of the parties.

Pursuant to Rule 59(1)(a) of the Rules of the Supreme Court of Canada, the intervener shall pay to the appellants and the respondent any additional disbursements resulting from their intervention.

(PUBLICATION BAN IN CASE)

An accused was charged with several offences. Before the jury selection process began, a ban on publication was imposed on all pre-trial applications in the proceedings pursuant to s. 648(1) of the Criminal Code. A consortium of major media outlets applied to have the ban clarified and declared applicable only after the jury is empaneled. The motion judge dismissed the application.
