2024-07-26 Judgment on the appeal rendered, CJ Ka Côt Row Mar Kas Ja Ob Mor, The appeals from the judgment of the Court of Appeal for Ontario, Numbers C66455 and C68595, 2021 ONCA 779, dated November 5, 2021, heard on November 8, 2023, are allowed in part and the cross-appeals are dismissed.

It is declared that:

1. Under the Augmentation Clause of the Robinson Treaties, the Crown has a duty to consider, from time to time, whether it can increase the annuities without incurring loss.

2. If the Crown can increase the annuities without incurring loss, it must exercise its discretion as to whether to increase the annuities and, if so, by how much.

3. In carrying out these duties and in exercising its discretion, the Crown must act in a manner consistent with the honour of the Crown, including the duty of diligent implementation.

4. The Crown’s discretion must be exercised diligently, honourably, liberally, and justly. Its discretion is not unfettered and is subject to review by the courts.

5. The Crown dishonourably breached the Robinson Treaties by failing to diligently fulfill the Augmentation Clause.

6. The Crown is obliged to determine an amount of honourable compensation to the Superior plaintiffs for amounts owed under the Augmentation Clause for the period between 1875 and the present.

In addition, further directions are provided at paras. 305 to 310 of the Court’s reasons for judgment.

The stay imposed in respect of the Stage Three trial proceedings shall continue for an additional six months from the release of the present judgment.

The respondents/appellants on cross-appeal are awarded their costs of the appeals and cross-appeals, on a solicitor-client basis.

In 1850, the respondents, the Anishinaabe of the northern shores of Lakes Huron and Superior, entered into two treaties with the Crown: the Robinson-Huron Treaty and the Robinson-Superior Treaty (“Treaties”). The Treaties provided for cessation of a vast territory in northern Ontario, and for payment, in perpetuity, of an annuity to the Anishinaabe. The initial agreed-upon sum was paid and an Order-in-Council declared them ratified and confirmed. In 1875, the annuity was increased to $4 (£1) per person, and, in 1877, the Huron and Superior chiefs petitioned successfully for arrears on the increase since the conditions for increasing the annuity had been met long before the increase. The annuity has not changed since.

The Huron respondents initiated an action against Canada and Ontario seeking declaratory and compensatory relief related to the interpretation, implementation and alleged breach of the annuity provisions in the Robinson-Huron Treaty; the Superior respondents made the same claims under the Robinson-Superior Treaty. The actions were tried together, split into three stages. At Stage One, the Treaties were interpreted, at Stage Two, the defences of Crown immunity and limitations were addressed, and, at Stage Three, the remaining issues (inter alia, damages and the allocation of liability) stood to be addressed. This appeal relates to Stages One and Two. A settlement with respect to claims for past breaches of the annuity provisions was reached with the Huron respondents. Stage Three of the trial, with only the Superior respondents participating, has been heard and judgment is under reserve, but has been stayed pending a decision from the Supreme Court of Canada.

The factums of the appellant, the respondent and the intervener will be posted here at least 2 weeks before the hearing unless they contain personal information, information that is subject to a publication ban, or any other information that is not part of the public record. You may also obtain copies of factums by filling out the Request for Court records form or by contacting the Court’s Records Centre either by email at records-dossiers@scc-csc.ca or by telephone at 613‑996‑7933 or at 1‑888‑551‑1185.
