AND UPON APPLICATION by the respondent for an extension of time to serve and file his factum, record and book of authorities to November 2, 2022;

AND HAVING REGARD TO the judgment of April 14, 2022, granting leave to appeal and to adduce new evidence;

AND HAVING REGARD TO the Notice of constitutional question filed by the appellants on May 16, 2022, setting out the following constitutional question:
Whether s. 9(1) of the Official Languages Act, R.S.N.W.T. 1998, c. 0-1, is inoperative to the extent it is incompatible with s. 19(1) of the Canadian Charter of Rights and Freedoms.

AND HAVING REGARD TO the order of July 6, 2022, granting leave to adduce new evidence and granting leave in part to adduce new evidence in reply;

AND HAVING REGARD TO the Notice to the Profession of November 2021 concerning interventions which provides, inter alia, that interveners must not challenge findings of fact, introduce new issues, or try to expand the case;

AND THE MATERIAL FILED having been read;

IT IS HEREBY ORDERED THAT:

The motions for extensions of time are granted.

Leave to intervene is granted to the Canadian Francophonie Research Chair in Language Rights; the Commissioner of Official Languages of Canada; the Fédération nationale des conseils scolaires francophones; the Commission nationale des parents francophones; the Société de l’Acadie du Nouveau-Brunswick; and the Yukon Francophone School Board. These interveners shall be entitled to each serve and file a factum not to exceed ten (10) pages in length on or before December 14, 2022, and are each granted permission to present oral argument not exceeding five (5) minutes at the hearing of the appeal.

Leave to intervene is denied to the Canadian Bar Association and the Fédération des associations de juristes d’expression francaise de common law inc. as their motions for leave to intervene raise a new issue, being the interpretation and application of s. 133 of the Constitution Act, 1867. These interventions, if allowed, would have the effect of expanding the case.

Leave to intervene is denied to the Société de la francophonie manitobaine and l’Association des juristes d’expression francaise du Manitoba (jointly), as their motion for leave to intervene raises a new issue, being the interpretation and application of s. 23 of the Manitoba Act, 1870. These interventions, if allowed, would have the effect of expanding the case.

Leave to intervene is denied to the Association des juristes d’expression française du Nouveau Brunswick inc. as its amended motion for leave to intervene raises a new issue, being the application of ss. 16(1) and 20(1) of the Canadian Charter of Rights and Freedoms to the territories. This intervention, if allowed, would have the effect of expanding the case.

Leave to intervene is granted to the Attorney General of the Yukon Territory on the first issue raised in the appeal. Consistent with the order of the Registrar dated August 17, 2022, the Attorney General of the Yukon Territory shall file a factum not to exceed ten (10) pages in length with respect to both issues on appeal, a record, and a book of authorities, if any, four (4) weeks following the receipt of the respondent’s factum.

Also consistent with the order of the Registrar dated August 17, 2022, the Attorney General of the Yukon Territory is granted permission to present oral argument not exceeding ten (10) minutes at the hearing of the appeal with respect to both issues on appeal.

The appellants and respondent are each entitled to serve and file a single factum in reply to all interventions not exceeding five (5) pages in length on or before December 21, 2022.

The interveners or groups of interveners are not entitled to raise new issues or to adduce further evidence or otherwise to supplement the record of the parties.

Pursuant to Rule 59(1)(a) of the Rules of the Supreme Court of Canada, the interveners or groups of interveners shall pay to the appellants and the respondent any additional disbursements resulting from their interventions.

In 2018 and 2019, the Minister of Education, Culture and Employment of the Northwest Territories denied six applications for admission to French-language schools made by non-rights holder parents. The ineligibility of their children was assessed according to the criteria established in the Ministerial Directive — Enrolment of Students in French First Language Education Programs developed by the government of the Territories. Because none of the criteria in the Directive applied in the circumstances, the parents asked the Minister to exercise her residual discretion to authorize the admission of the six children concerned, which was denied. The non-rights holder parents and the school board applied for judicial review of the Minister’s decisions. In two judgments, the Northwest Territories Supreme Court set aside the Minister’s decisions on the ground that there had been no proportionate balancing of the protections guaranteed by s. 23 of the Charter and the government’s interests. The majority of the Court of Appeal allowed the Minister’s appeals and restored her decisions. The court found that the chambers judge’s reasoning on constitutional values had proceeded on the mistaken assumption that the case involved constitutional rights. The families in question did not qualify under s. 23 because they were not rights holders, and they therefore had no legal or statutory right or expectation to have their children attend the French-language schools.
