Decision on the motion for leave to intervene, Mo, UPON APPLICATION by the Insolvency Institute of Canada, the Young Canadian Arbitration Practitioners, the Canadian Federation of Independent Business, the Canadian Commercial Arbitration Centre, the Chartered Institute of Arbitrators (Canada) Inc., the Arbitration Place, the ADR Institute of Canada Inc. and the Toronto Commercial Arbitration Society for leave to intervene in the above appeal; AND THE MATERIAL FILED having been read; IT IS HEREBY ORDERED THAT: The motions for leave to intervene by the Young Canadian Arbitration Practitioners, the ADR Institute of Canada Inc. and the Toronto Commercial Arbitration Society are dismissed. The motions by the Insolvency Institute of Canada, the Canadian Federation of Independent Business, the Canadian Commercial Arbitration Centre, the Chartered Institute of Arbitrators (Canada) Inc. and the Arbitration Place are granted and the said five (5) interveners shall be entitled to serve and file a single factum not to exceed ten (10) pages in length on or before December 20, 2021. The Insolvency Institute of Canada is granted permission to present oral arguments not exceeding ten (10) minutes at the hearing of the appeal. The Canadian Federation of Independent Business, the Canadian Commercial Arbitration Centre, the Chartered Institute of Arbitrators (Canada) Inc. and the Arbitration Place are granted permission to present oral arguments not exceeding five (5) minutes each at the hearing of the appeal. The respondents are granted permission to serve and file a single factum in response to all interventions, not to exceed ten (10) pages in length, on or before January 4, 2022. The interveners are not entitled to raise new issues or to adduce further evidence or otherwise to supplement the record of the parties. Pursuant to Rule 59(1)(a) of the Rules of the Supreme Court of Canada, the interveners shall pay to the appellant and the respondent any additional disbursements resulting from their interventions. The parties entered into a partnership agreement and a guarantee and cross-indemnity agreement. The partnership, Peace River Hydro Partners, commenced work. It subcontracted some work to Petrowest Corporation and its affiliates pursuant to purchase orders and it entered into a subcontract agreement with Petrowest Civil Services LP. Petrowest Corporation and its affiliates became insolvent. Ernst and Young Inc. was appointed as their receiver. Ernst & Young Inc. assigned Petrowest Corporations’s affiliates into bankruptcy and thereafter acted as both a trustee in bankruptcy and a receiver. Petrowest Corporation and its affiliates commenced a civil claim alleging amounts are owed to them under the general partnership agreement, the guarantee and cross-indemnity agreement, the purchase orders, and the subcontract agreement. These agreements contain arbitration clauses. The appellants applied under s. 15 of the Arbitration Act, RSBC 1996, c. 55, to stay the proceedings so that the matters could be referred to arbitration. The Supreme Court of British Columbia dismissed the application. The Court of Appeal dismissed an appeal.
