Criminal law Defences Provocation Whether defence of provocation meets air of reality test.

The respondent was convicted of second degree murder in respect of the death of her sister in law. The majority of the Court of Appeal allowed her appeal and ordered a new trial on the basis that the trial judge had erred in failing to bring s. 232 of the Criminal Code, which sets out the defence of provocation, to the jury’s attention. Rochon J.A., dissenting, would have dismissed the appeal. In his opinion, that defence did not have to be put to the jury, because the evidence did not lend an air of reality to it.
