LEBEL J. — The Court is unanimously of the view that the appeal should be allowed. The judge who presided over the appellant’s trial gave, in response to a specific question from the jury on being an accessory and being a party to an offence, additional instructions that were incomplete and confusing. Moreover, although we need not rule on this issue for the purposes of this appeal, the nature of the charges against the appellant raises the question whether it would be possible to base a conviction for first degree murder under s. 231(5) Cr. C. on the accused being a party to the offence within the meaning of s. 21(2) Cr. C. For these reasons, the appeal is allowed, the verdict of guilty is set aside, and the Court orders that a new trial be held in respect of the same charges.

Criminal law Instructions to jury Whether Court of Appeal erred in minimizing extent to which jury’s deliberations and verdicts were affected by absence of additional instructions concerning “knowledge” element of being accessory to murder under s. 21(2) of Criminal Code, to which jury’s question had clearly been directed.

This appeal concerns a guilty verdict returned by a jury on a charge of first degree murder. The appellant, Pierre Lévesque, and his accomplice, Mr. Denver Lambert, met several times to plan a theft involving weapons that were supposed to be used solely to secure the cooperation of the future victims and facilitate the theft. On April 9, 1994, inside a residence in Val Bélair, a police officer found the body of 75 year old Béatrice Lavoie, who was lying in a pool of blood with her feet and hands bound with tape, and 82 year old Maurille Lepage, who was lying on the floor tied up the same way as his spouse and who also had tape over his eyes.
