DESCHAMPS J. - We agree with Hoegg J.A., dissenting at the Court of Appeal, that the trial judge committed no reviewable error. Therefore, the appeal is allowed.
Having heard the parties, we also agree with the dissenting judge that Count No. 1 should be stayed and that the convictions on the other Counts should be restored.

Criminal law - Evidence - Similar fact evidence - Admissibility - Probative value - Whether the trial judge erred in his interpretation and application of the law when he admitted the similar fact evidence - Application of R. v. Handy, [2002] 2 S.C.R. 908.

The respondent, T.L.M. was convicted of sexual assault, sexual interference and invitation to touch for a sexual purpose. He was the uncle, by marriage, of the complainant. She was 8 to 10 years old at the time of the alleged offences. In each instance, the offence was alleged to have occurred with only the complainant and T.L.M. present, although others were said to have been nearby on several occasions. The trial judge admitted as similar fact evidence an agreed statement of facts relating to T.L.M.’s prior conviction for sexual assault on another eight year old girl at her home. The trial judge found that it served to rebut the defences of innocent association and lack of opportunity, and bolstered the complainant’s credibility. The majority of the Court of Appeal allowed T.L.M.’s appeal and ordered a new trial. In its view, the trial judge erred in according undue probative value to the similar fact evidence in the context of the test for admissibility. Finding the trial judge’s decision to admit the evidence deserving of deference, and finding no error in his approach or analysis in doing so, Hoegg J.A., dissenting, would have dismissed the appeal.
