Charter of Rights - Freedom of expression - Freedom of the press - Defamation - Defence of qualified privilege - Whether common law of defamation governing availability of defence of qualified privilege to media for publications to world at large is inconsistent with freedom of the press as guaranteed by s. 2(b) of the Canadian Charter of Rights and Freedoms - Whether party in civil action is entitled to benefit from change in law that occurs between time of trial and hearing of appeal, in circumstances where law is changed to give effect to a Charter right.

The Respondent is an OPP constable who, on his own initiative, went to New York City to participate in the search and rescue operations immediately following the September 11, 2001 attack on the World Trade Center. The Ottawa Citizen published three articles casting the Respondent and his rescue activities in a negative light. The Respondent brought a defamation action against the Citizen and the authors of the Citizen articles (the Appellants). At the conclusion of the evidence, counsel for the Appellants asked the trial judge to instruct the jury that the publication of the three articles was an occasion of qualified privilege and that the claim should be dismissed unless the Respondent satisfied the jury that the Appellants were guilty of malice. The Respondent was awarded damages and costs. On appeal, the appeal was dismissed.
