2019-12-13 Judgment on the appeal rendered, CJ Abe Mo Ka Br Row Mar, The appeal from the judgment of the Court of Appeal for British Columbia (Vancouver), Number CA44026, 2018 BCCA 47, dated February 7, 2018, heard on May 13, 2019, is dismissed without costs. As a provincial Crown agent, the British Columbia Investment Management Corporation (BCI) is immune from taxation by Canada under the Excise Tax Act, R.S.C. 1985, c. E-15, in respect of assets BCI holds in pooled investment portfolios under the Pooled Investment Portfolios Regulation, B.C. Reg 447/99. Wagner C.J. dissents.

The cross-appeal from the judgment of the Court of Appeal for British Columbia (Vancouver), Number CA44026, 2018 BCCA 47, dated February 7, 2018, heard on May 13, 2019, is dismissed without costs. Under s. 16(6) of the Public Sector Pension Plans Act, S.B.C. 1999, c. 44, BCI is nevertheless subject to the provisions of the Reciprocal Taxation Agreement and the Comprehensive Integrated Tax Coordination Agreement respecting those assets to the same extent as Her Majesty the Queen in Right of the Province of British Columbia.
